What if a game character can kill the player while in the pause menu would this count as 4th wall breaking.

Yeah, sort of, a normal character can't do that, they need to be 4th wall aware and interfering with the pause menu is not something a normal character can do.

It would depend on the verse. In FromSoftware games the pause menu doesn't pause the game
