Would this be enough for layers?

Level 1 has, say, mind hax. It works on other level 1s, but doesn't work on level 2s. Level 2s also has mind hax, but it doesn't work on level 3s. Is this enough to assume each level has a layer, and assume the later levels also have layers? Especially if we consider a statement like "Every level up increases the strength of abilities." and "Abilities aren't strong enough to work on higher level people"?

Also, this has been shown for multiple haxes, like illusion, poison, soul, etc... would it be plausible to assume that a higher level is just resistant to everything of a lower level?

Probably yes, with these feats it should be enough to get the layering hax criteria.

Layering is the ability to break through resistances to one's ability/hax. Successfully using an ability against a resistant character means that the ability is "layered." Further, resisting a layered ability is an indication of layered resistance, so on and so forth. An ability becoming stronger does not automatically mean it is layered unless it is shown to overcome a resistance. Crucially this is not the same as resistance negation, against which layering is irrelevant.
